《政府租契续期条例》(第648章)(《条例》)第二份「续期公告」于今日(12月27日)刊登,涵盖2031年内到期的「一般用途地契」(即一般住宅、商业、工业地契),全部获得续期50年。

获续期的地契免补地价,但须每年缴付应课差饷租值3%的地租。获续期地契原有的产权负担、权益及权利(例如按揭)将自动过渡。

「续期免签约」的安排为地契续期提供确定性,业权人无须办理任何手续,省却业权人逐一与政府签立续期文件、重新办理按揭等繁复手续。

《条例》提升业权人和投资者对物业市场的信心,便民利商,亦体现「一国两制」行稳致远,为香港繁荣稳定提供坚实保障。

The second Extension Notice under the Extension of Government Leases Ordinance (Cap. 648) (the Ordinance) was published today (December 27). All “general purpose leases” (i.e. general residential, commercial and industrial leases) expiring in 2031 have been extended for 50 years.

Leases extended do not require payment of additional premium but are subject to payment of 3% rateable value as annual government rent. The encumbrances, interests and rights under the original lease (such as mortgages) will be carried forward to the extended lease term without being affected.

The arrangement of extending land leases without having to execute a new contract provides certainty for lease extension. Owners do not have to perform any procedures, hence obviating the need for owners to undergo cumbersome procedures such as executing lease extension documents with the Government individually, re-arranging the mortgages, etc.

The Ordinance enhances the confidence of property owners and investors in the real estate market, brings convenience to the public and businesses, and manifests the solid safeguards for the long-term prosperity and stability of Hong Kong under the steadfast and successful implementation of “One Country, Two Systems”.
